Webfeet and PB Settle

Just a final update on suit against the PB. Of course the attorney is the one that came out ahead, he made $1500.00! :eek: The PB and I reached an out of court settlement. He has agreed for me to keep the final payment of about $5800.00 that I owed him. I have to pay the concrete company- they agreed to discount their bill about $700.00 and settled for $1100.00. PB paid 1/2 my attorney fees ($750.00). So, I'm out the $1100.00 for concrete, $750 for my attorney, and $200.00 filing fee. I have about $3750.00 left to apply to fixing the stained deck. Moreover, now I don't have to worry about anyone putting a lien on my house. :) I could have went to court, but decided to absorb some loss myself, so that we could get this behind us. :)

Hey, congradulations on getting that behind you. I'm sure it feels a lot better now that you won't have to deal with any of that. I wouldn't have wanted to see the lawyers bill if you tried to go to court.

Out of curiosity, how much do you think you lost by settling? I guess you figure additional attorney fees, time off work, stress, and risk of losing are all factors to figure into a settlement decision as well.

Sounds like you're happy with it so that's all that matters in my book.

I don't know what I could have gotten, but think we were going to ask for about $10,000. However, you can't get blood out of a turnip, as the old saying goes, so we figured that we would have gotten a judgement against the PB, but no money. Yes, we factored all the things you said, too.

Good point. Winning a judgment doesn't mean you'll get any money.

My brother rented a house to a couple that didn't pay him. He sued, then settled with them for half of what they owed. But then they still didn't pay and he had to go through collections to get the money. For him, in retrospect, he would have been better off not settling since he had to go through collections anyway and could have gotten the whole amount. He was too nice to be a landlord.
