cracked foundation from pool install

Did anyone else have this happen to them? The foundation wall next to where all the trucks traveled in and out of our yard has a crack from a window corner down almost to the floor and there is a little water leakage-not enough to puddle, but it's there.
There was a clause in our contract absolving the pool company of any responsibility for cracked foundations so I am thinking this isn't that unusual?
I read somewhere that the cause of a crack is most important. Since it was an outside force, and not natural settling I am thinking I need not to worry too much?

Any one else with this issue?
